Acceptance of Terms

By accessing or using iMark CRM, you agree to be bound by these Terms & Conditions. If you are using the platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms. If you do not agree with any part of these terms, you must not use iMark CRM.

Service Description

iMark CRM is a cloud-based Customer Relationship Management platform designed for Indian real estate companies. It operates as a multi-tenant Software-as-a-Service (SaaS) product, providing tools for lead management, deal tracking, payment processing, compliance management, and team collaboration.

Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activities that occur under your account.
  • Notifying us immediately if you suspect unauthorised access to your account.

Do not share your password with others. Each user must have their own account with their own credentials. Administrators are responsible for managing user access within their organisation.

Acceptable Use

You agree not to use iMark CRM to:

  • Conduct any illegal activity or store illegal content.
  • Scrape, crawl, or extract data from the platform using automated means without written permission.
  • Reverse engineer, decompile, or disassemble any part of the software.
  • Attempt to gain unauthorised access to other organisations' data or system infrastructure.
  • Upload malware, viruses, or any other harmful code.
  • Use the platform in a way that degrades performance for other users.

Data Ownership

Your organisation owns the data it enters into iMark CRM. We act as a data processor on your behalf, not as the owner of your data. You retain all rights to your business data, including leads, deals, customer records, and documents.

You may export your data at any time through the CRM's built-in export features or by contacting our support team.

Service Availability

We strive to maintain 99.9% uptime for iMark CRM, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice via email or in-app notification).
  • Emergency security patches or critical bug fixes.
  • Circumstances beyond our control, including internet outages, hosting provider issues, or force majeure events.

Subscription and Billing

  • Plans are billed either monthly or annually, depending on your chosen billing cycle.
  • All prices are in Indian Rupees (INR) and exclusive of applicable GST (18%).
  • Cancellation takes effect at the end of your current billing period. You will continue to have access until then.
  • We do not offer refunds for partial billing periods.
  • We reserve the right to change pricing with 30 days' advance written notice.

RERA Compliance Disclaimer

iMark CRM includes features that help enforce Real Estate (Regulation and Development) Act, 2016 (RERA) requirements, including:

  • Booking amount capped at 10% of total consideration.
  • Carpet area-based pricing as the primary measurement.
  • RERA registration number tracking for projects.

However, your organisation is solely responsible for ensuring full legal compliance with RERA and all other applicable laws. iMark CRM is a tool to assist compliance, not a substitute for legal counsel.

Limitation of Liability

To the maximum extent permitted by applicable law, iMark Infotech Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of iMark CRM.

Our total aggregate liability for any claim arising from or related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Intellectual Property

iMark CRM, including its software, design, logos, and documentation, is the intellectual property of iMark Infotech Pvt. Ltd.. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform for your internal business purposes.

Termination

We may suspend or terminate your access to iMark CRM if you violate these terms, fail to pay subscription fees, or engage in activities that harm the platform or other users. Upon termination, you may request an export of your data within 30 days.

Governing Law and Jurisdiction

These terms are governed by the laws of India. Any disputes arising from or related to these terms or your use of iMark CRM shall be subject to the exclusive jurisdiction of the courts in Chandigarh, India.

Changes to These Terms

We may update these Terms & Conditions from time to time. When we make material changes, we will notify you via email or through a prominent notice within the CRM at least 15 days before the changes take effect.
